本利用規約（以下「本規約」といいます）は、くもたん（以下「本アプリ」といいます）の利用条件を定めるものです。本アプリを利用する全てのユーザー（以下「ユーザー」といいます）は、本規約に同意の上、本規約に従って本アプリを利用するものとします。
1. 本規約は、ユーザーと本アプリの運営者（以下「運営者」といいます）との間の本アプリの利用に関わる一切の関係に適用されるものとします。
2. 運営者は本アプリに関し、本規約のほか、ご利用にあたってのルール等、各種の規定（以下「個別規定」といいます）を定めることがあります。これら個別規定はその名称のいかんに関わらず、本規約の一部を構成するものとします。
1. 本アプリは、AT Protocol（Bluesky等）のタイムラインを閲覧しながら、英語の単語・熟語を日本語で学習するための語彙学習支援ツールです。
2. 本アプリは、以下の主な機能を提供します。
AI辞書・翻訳機能は、ユーザー自身が取得したGoogle AI StudioのAPIキー（Gemma4）を使用します。APIキーの取得・管理はユーザーの責任において行うものとします。
1. 本アプリの利用には、Blueskyアカウントによるログインが必要です。ユーザーは、AT Protocol OAuth認証を通じてBlueskyアカウントでログインすることにより、本アプリの利用を開始するものとします。
2. 運営者は、本アプリの利用に際して、ユーザーのBlueskyアカウントのパスワード等の認証情報を取得・保存することはありません。
1. ユーザーは、自己の責任において、本アプリの利用に使用するBlueskyアカウントを適切に管理するものとします。
2. ユーザーのBlueskyアカウントが第三者によって不正に使用されたことによって生じた損害について、運営者は一切の責任を負わないものとします。
3. ユーザーが本アプリに設定したGemma APIキーの管理は、ユーザーの責任において行うものとします。APIキーの漏洩・不正使用等によって生じた損害について、運営者は一切の責任を負わないものとします。
1. 本アプリにおけるユーザーデータ（登録した単語、学習統計等）は、ユーザーの端末内でローカル保存されます。運営者のサーバーへ送信・保存されることはありません。
2. 本アプリは、AT Protocolの仕組みに基づき、登録した単語データおよび学習進捗をユーザー自身のPDS（Personal Data Server）に同期する機能を提供します。PDSに保存されたデータは、ユーザー自身が所有・管理するものであり、運営者がこれを管理・閲覧することはありません。
3. PDSへのデータ同期は、端末変更やアプリ再インストール時のデータ復元を目的としています。PDS側の障害やデータ消失について、運営者は一切の責任を負わないものとします。
4. 端末の故障、アプリの削除、その他の事由によりローカルデータが失われた場合、運営者はデータの復旧について一切の責任を負わないものとします。
5. ユーザーは、必要に応じて本アプリのデータエクスポート機能を利用し、自己の責任においてデータのバックアップを行うものとします。
1. 本アプリに関連する全ての知的財産権（著作権、商標権、意匠権等）は、運営者または正当な権利を有する第三者に帰属します。
2. ユーザーは、本アプリを通じて取得・保存した学習データについて、私的利用の範囲内で自由に利用することができるものとします。
ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。
1. 法令または公序良俗に違反する行為
2. 犯罪行為に関連する行為
3. 本アプリまたは関連するサーバー・ネットワークの機能を破壊したり、妨害したりする行為
4. 運営者のサービスの運営を妨害するおそれのある行為
5. 他のユーザーに関する個人情報等を収集または蓄積する行為
6. 不正アクセスをし、またはこれを試みる行為
7. 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル等の行為（オープンソースライセンスに基づく範囲を除く）
8. 本アプリを利用した営利目的の活動（運営者が別途許可した場合を除く）
9. 反社会的勢力に対して直接または間接に利益を供与する行為
10. 他のユーザーに対する誹謗中傷、嫌がらせ、脅迫、ストーキングその他の迷惑行為
11. 差別的表現、ヘイトスピーチ、暴力を助長する表現を含むコンテンツの投稿
12. 性的・わいせつなコンテンツ、児童の性的搾取に該当するコンテンツの投稿
13. なりすまし、虚偽の情報の流布、スパム行為
14. その他、運営者が不適切と判断する行為
1. 本アプリは、以下の外部サービスおよびデータを利用して機能を提供します。
2. AI辞書機能について: ユーザーが設定画面でGemma APIキーを設定した場合、本アプリで検索した単語がGoogle AI Studio（Gemma4）APIに直接送信され、定義・翻訳・例文・コロケーション・ニュアンスが取得されます。このデータは辞書検索の目的にのみ使用され、運営者が保存することはありません。GoogleのAPI利用規約では、APIを通じて送信されたデータはデフォルトではモデルの学習に使用されないと定められています。
各外部サービスの利用規約が別途適用されます。ユーザーは各外部サービスの利用規約を遵守する責任を負うものとします。外部サービスの仕様変更・障害・終了等により本アプリの一部機能が利用できなくなった場合、運営者は一切の責任を負わないものとします。
1. 本アプリには、学習進捗をBlueskyに投稿する機能があります。ユーザーは、当該機能の利用にあたり、投稿内容がBluesky上で公開されることを理解し、自己の責任において利用するものとします。
2. ユーザーが本アプリを通じてBlueskyに投稿した内容について、運営者は一切の責任を負わないものとします。
3. 本アプリは、Blueskyのコンテンツラベルに基づき、センシティブなコンテンツに対して警告表示を行います。
4. 【不適切なコンテンツ・迷惑行為の禁止】運営者は、不適切なコンテンツおよび他のユーザーに対する迷惑行為を一切許容しません（no tolerance）。第7条各号に該当する投稿・行為は禁止されます。
5. 【通報】ユーザーは、本アプリのタイムラインに表示される投稿の通報アイコン、またはユーザープロフィールの「通報」から、不適切な投稿および迷惑行為を行うユーザーを通報することができます。通報された投稿は、送信と同時にユーザーの端末上で非表示となります。
6. 【対応】運営者は、通報を受けた場合、24時間以内に内容を確認し、不適切と判断したコンテンツの削除およびコンテンツを投稿したユーザーの排除（アプリの利用制限）を含む必要な措置を講じます。本アプリはBlueskyのクライアントであるため、通報はBluesky（AT Protocol）のモデレーションサービスにも同時に送信され、ネットワーク全体での対応が行われます。
7. 【ブロック】ユーザーは、ユーザープロフィールから任意のユーザーをブロックすることができます。ブロックしたユーザーの投稿は本アプリに表示されなくなります。
運営者は、以下のいずれかの事由があると判断した場合、ユーザーへの事前通知なく本アプリの全部または一部の提供を停止または中断することができるものとします。
1. 本アプリにかかるシステムの保守点検または更新を行う場合
2. 地震、落雷、火災、停電または天災などの不可抗力により、本アプリの提供が困難となった場合
3. コンピュータまたは通信回線等が事故により停止した場合
4. 外部サービス（Bluesky、Google AI Studio、Cloudflare Workers等）の障害・仕様変更等により、本アプリの提供が困難となった場合
5. その他、運営者が本アプリの提供が困難と判断した場合
運営者は、ユーザーが以下のいずれかに該当する場合には、事前の通知なく、ユーザーに対して本アプリの全部もしくは一部の利用を制限することができるものとします。
1. 本規約のいずれかの条項に違反した場合
2. その他、運営者が本アプリの利用を適当でないと判断した場合
1. 運営者は、本アプリに事実上または法律上の瑕疵がないことを保証しておりません。ここでいう瑕疵には、安全性、信頼性、正確性、完全性、有効性、特定目的への適合性、セキュリティに関する欠陥、エラーやバグ、権利侵害などを含みます。
2. 運営者は、本アプリの利用によりユーザーに生じた、直接的または間接的な損害について、一切の責任を負いません。
3. 本アプリが提供する辞書検索結果、翻訳結果、テキスト解析結果等の正確性、完全性について、運営者は一切の保証をしません。
4. 本アプリはオープンソースソフトウェアとして提供されており、現状有姿（AS IS）で提供されます。
運営者は、ユーザーに通知することなく、本アプリの内容を変更しまたは本アプリの提供を中止することができるものとし、これによってユーザーに生じた損害について一切の責任を負いません。
1. 運営者は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。
2. 本規約の変更後、本アプリの利用を継続した場合には、当該ユーザーは変更後の規約に同意したものとみなします。
運営者は、本アプリの利用によって取得する個人情報については、別途定める「プライバシーポリシー」に従い適切に取り扱うものとします。
1. 本規約の解釈にあたっては、日本法を準拠法とします。
2. 本アプリに関して紛争が生じた場合には、運営者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
These Terms of Service (hereinafter "these Terms") set forth the conditions of use for Kumotan (hereinafter "this App"). All users (hereinafter "Users") who use this App shall agree to these Terms and use this App in accordance with them.
1. These Terms shall apply to all matters relating to the use of this App between Users and the operator of this App (hereinafter the "Operator").
2. The Operator may establish various rules and regulations (hereinafter "Individual Provisions") regarding the use of this App, in addition to these Terms. Such Individual Provisions shall constitute a part of these Terms regardless of their title.
1. This App is a vocabulary learning support tool for learning English words and phrases in Japanese while browsing AT Protocol (Bluesky, etc.) timelines.
2. This App provides the following main features:
The AI-powered dictionary and translation features use Google AI Studio (Gemma4) via the User's own API key. Users are responsible for obtaining and managing their Gemma API key.
1. Use of this App requires login with a Bluesky account. Users shall begin using this App by logging in with their Bluesky account through AT Protocol OAuth authentication.
2. The Operator does not obtain or store authentication credentials such as passwords for Users' Bluesky accounts.
1. Users shall properly manage the Bluesky account used for this App at their own responsibility.
2. The Operator shall not be liable for any damages arising from unauthorized use of a User's Bluesky account by a third party.
3. Users are responsible for managing the Gemma API key set in this App. The Operator shall not be liable for any damages arising from leakage or unauthorized use of API keys.
1. User data in this App (registered words, learning statistics, etc.) is stored locally on the User's device. User data is not transmitted to or stored on the Operator's servers.
2. This App provides a function to sync registered vocabulary data and learning progress to the User's own PDS (Personal Data Server) based on the AT Protocol framework. Data stored on PDS is owned and managed by the User, and the Operator does not manage or access it.
3. Data synchronization to PDS is intended for data restoration when changing devices or reinstalling the App. The Operator shall not be liable for any PDS-side failures or data loss.
4. The Operator shall not be liable for data recovery if local data is lost due to device failure, app deletion, or other reasons.
5. Users shall back up their data at their own responsibility using the data export function of this App as needed.
1. All intellectual property rights (copyrights, trademark rights, design rights, etc.) related to this App belong to the Operator or third parties with legitimate rights.
2. Users may freely use learning data obtained and saved through this App within the scope of personal use.
Users shall not engage in the following actions when using this App:
1. Actions that violate laws or public order and morals
2. Actions related to criminal activity
3. Actions that destroy or interfere with the functions of this App or related servers/networks
4. Actions that may interfere with the operation of the Operator's services
5. Collecting or accumulating personal information of other users
6. Unauthorized access or attempts thereof
7. Reverse engineering, decompilation, or disassembly of this App (except within the scope of open source licenses)
8. Commercial activities using this App (unless separately permitted by the Operator)
9. Directly or indirectly providing benefits to antisocial forces
10. Defamation, harassment, threats, stalking, or any other abusive behavior toward other users
11. Posting content containing discriminatory expressions, hate speech, or incitement to violence
12. Posting sexual or obscene content, or content constituting child sexual exploitation
13. Impersonation, spreading false information, or spam
14. Any other actions deemed inappropriate by the Operator
1. This App uses the following external services and data to provide its features:
2. AI Dictionary Feature: When the User sets their Gemma API key in Settings, words looked up in this App are sent directly to the Google AI Studio (Gemma4) API to retrieve definitions, translations, example sentences, collocations, and nuance. This data is processed solely for dictionary lookup and is not stored by the Operator. Google's API terms of service state that data submitted via the API is not used for model training by default.
The terms of service of each external service apply separately. Users are responsible for complying with the terms of service of each external service. The Operator shall not be liable if some features become unavailable due to specification changes, failures, or termination of external services.
1. This App includes a feature to post learning progress to Bluesky. Users shall understand that posted content will be publicly available on Bluesky and use this feature at their own responsibility.
2. The Operator shall not be liable for any content posted to Bluesky through this App.
3. This App displays warnings for sensitive content based on Bluesky's content labels.
4. [No tolerance] The Operator has zero tolerance for objectionable content and for abusive behavior toward other users. Any post or conduct described in Article 7 is prohibited.
5. [Reporting] Users can report objectionable posts using the flag icon on any post in the timeline, and can report abusive users from the user profile. A reported post is hidden on the user's device as soon as the report is sent.
6. [Enforcement] The Operator reviews every report within 24 hours and takes the necessary measures, including removing content deemed objectionable and ejecting the user who provided it (restricting their use of the App). As this App is a Bluesky client, reports are also forwarded to the moderation service of Bluesky (AT Protocol) so that action can be taken network-wide.
7. [Blocking] Users can block any user from that user's profile. Posts from blocked users no longer appear in this App.
The Operator may suspend or interrupt all or part of this App without prior notice to Users if any of the following reasons apply:
1. When performing maintenance or updates to the systems of this App
2. When provision of this App becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
3. When computers or communication lines are stopped due to accidents
4. When provision of this App becomes difficult due to failures or specification changes of external services (Bluesky, Google AI Studio, Cloudflare Workers, etc.)
5. When the Operator determines that provision of this App is otherwise difficult
The Operator may restrict all or part of a User's use of this App without prior notice if the User falls under any of the following:
1. When any provision of these Terms is violated
2. When the Operator otherwise determines that use of this App is inappropriate
1. The Operator does not warrant that this App is free from defects in fact or law. Such defects include defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, and infringement of rights.
2. The Operator shall not be liable for any direct or indirect damages incurred by Users from the use of this App.
3. The Operator makes no guarantees regarding the accuracy or completeness of dictionary search results, translation results, text analysis results, etc. provided by this App.
4. This App is provided as open source software and is provided "AS IS".
The Operator may change or discontinue the content of this App without notice to Users and shall not be liable for any damages incurred by Users as a result.
1. The Operator may change these Terms at any time without notice to Users when deemed necessary.
2. If a User continues to use this App after changes to these Terms, the User shall be deemed to have agreed to the revised Terms.
The Operator shall handle personal information obtained through the use of this App appropriately in accordance with a separately established "Privacy Policy".
1. Japanese law shall be the governing law for the interpretation of these Terms.
2. In the event of any dispute regarding this App, the court having jurisdiction over the Operator's location shall be the exclusive agreed court of first instance.
